Terms of services for users

1. Participation

I am aware of the fact that the ‘openresearch.amsterdam’ Platform (hereinafter referred to as the Platform) is facilitated by the municipality of Amsterdam with the aim of actively promoting collaboration, knowledge sharing and feedback between participants, and that members of affiliated government organisations and research institutions in the Amsterdam Metropolitan Area can place research and research results on the Platform.

 

2. Form of the platform

I am aware of the fact that the Platform has three different layers for research collaboration, knowledge sharing and placement.

  1. Layer 1 (project area): research can be shared within a project area with those participating in the research project.
  2. Layer 2 (within the Platform): research is shared within the Platform with others than just those who have received an account within the project area (layer 1).
  3. Layer 3 (Internet) research is shared on the Internet for all visitors who visit the Platform website.

 

3. Acting with care and integrity

I act on each layer of the Platform in a responsible and careful manner and as befits a good, careful and honest editor or participant. This includes at least (the list is not exhaustive) that I:

  • observe the guidelines set by the participating party through which I have obtained an account.
  • always act in accordance with the code of conduct that applies given my position.
  • will only place material on the Platform that is in line with the objectives of the Platform. 
  • only place research or research results on the Platform that are correct and which have been carefully created.
  • will not place any material on the Platform that is unlawful due to the content, for example, discriminatory or offensive content.
  • by placing research and research results on the Platform, make no unauthorised infringements on the rights of third parties. See also under the heading intellectual property rights.
  • place no secret/confidential information on the Platform and in the case of potentially sensitive topics, first consult with my supervisor.
  • place no personal data on the Platform as referred to in the General Data Protection Regulation (GDPR), unless an exception applies. See also under the heading Privacy/General Data Protection Regulation.
  • hold those accountable who do not act with care on the Platform.

 

4. Liability and accountability

I am aware of the fact that my access to the Platform is connected to my professional (work) environment and that the government organisation or knowledge Institution through which I am affiliated is responsible and liable to the Platform if by placing research and research results I inflict damage to third parties, even if I am not, or am not the only, author of the research and/or research results in question. I am aware that the government organisation or knowledge institution for which I work can hold me accountable for my actions on the Platform.

 

5. Use of layers 1 and 2

I am aware of the fact that I may not place (or have placed) on layer 2 or 3 of the Platform the research and research results that other participants have placed on layers 1 and 2, or otherwise disclose them. I may not use this research and research results without permission for purposes other than providing feedback and creating mutual interaction between participants.

 

6. Publication on public layer (layer 3)

Publication of research or research results on the public layer of the Platform takes place exclusively through the editor of the participating party for which I work.  Before I offer research to the editor for publication on the public layer, I will make a good summary. This summary is comprehensible for people with different levels of education. I will also add the relevant keywords.

 

7. Intellectual property rights

By placing research and research results on the Platform, I make no unauthorised infringements on the rights of third parties. I therefore make sure I check whether a publisher has research rights and if I am not the sole author of the research or research results, that the other authors have also given their permission for placement on the Platform. I also ensure that my research or research results do not include text, graphics, databases or other works for which rights rest with third parties who have not given permission for placement on the Platform.

 

If the research rights rest with third parties who have not given permission for placement on the Platform, then I will place only a summary with a link to where the research can be found.

 

8. License

I am aware that the research and research results are made available on the public layer to visitors under the user license for an indefinite period: Creative Commons license (attribution – non-commercial - share alike). Non-commercial is defined as: use by Visitors to the Platform for education, research, and public and social projects.

 

9. Privacy / General Data Protection Regulation

I am aware that I am responsible for meeting the obligations of the GDPR. I make sure that I do not place any personal data on the Platform that was collected as source data and/or used in the research. This means that I anonymise research, whereby I ensure an adequate level of aggregation. For anonymous data, it should be reasonably excluded to:

    1. identify an individual person ('traceability');
    2. associate different records with an individual ( 'connectivity'); and
    3. derive information about an individual (‘derivability’).

If anonymisation is not possible, I will render the research data pseudo-anonymous, so that the data is not traceable to an individual for others. I will notify the data subjects of this and ask for their consent for using the data in this way.

 

10. Accuracy of the data

If I encounter incorrect or outdated information on the Platform, I will inform the respective author/participant immediately using the email address indicated on the participant's profile page or via openresearch@amsterdam.nl.

 

11. Refrain from giving a false impression

I do not give the impression that other government organisations or knowledge institutions than those for which I work endorse the research or research results placed by me, or that the material placed by me concerns their (established) policies or positions.

 

12. Removal of research

I am aware that - if a third party files a complaint about my research - the Open Research Editorship immediately removes the research from the platform. The Open Research Editorship notifies this to the government organisation or knowledge institution from which I received this account, after which they contact me and further handle the complaint.

 

13. Denial of access to the Platform

I am aware of the fact that if at the discretion of the municipality, I violate any of these Conditions, or if the court passes such a judgment, that the Open Research Editorship is authorised to block my account and to remove my published research and research results.  In that case, the Open Research Editorship is also authorised to deny me access to the Platform and to revoke access rights.

 

14. Availability and Termination of the Platform

I am aware of the fact that in principle, the Platform is available 24/7, but that it may be temporarily unavailable due to maintenance.  Furthermore, I am aware that the municipality of Amsterdam may render the Platform inaccessible to visitors with immediate effect and may terminate or otherwise amend it within a reasonable time. In that case, a reasonable time will be given to archive own research.

 

15. Amendments to the Conditions

The Conditions for participation in the Platform are subject to change. In that case, a new version of these Conditions will be presented to me upon logging onto the Platform. I must actively agree to these Conditions before I can further participate in the Platform.
